Terms and Policies (revised: December 18, 2011)
BY ACCESSING ANY OF THE SERVICES OR PRODUCTS OFFERED BY ALLNET4U.COM WEB HOSTING YOU AGREE TO BE BOUND BY THIS ACCEPTABLE TERMS USE POLICY OF THIS AGREEMENT.
THESE TERMS AND CONDITIONS SUPERSEDE ALL EARLIER VERSIONS AND REQUIRE MANDATORY ARBITATION OF DISPUTES. YOU ARE RESPONSIBLE TO READ FREQUENTLY OUR TERMS ON THIS PAGE TO SEE IF THERE ARE MODIFICATIONS.
Please read these terms and conditions carefully, as they describe your legal rights and obligations.
This agreement shall become effective as of the date of
(1) your electronic signature on or acceptance of this agreement,
(2) the activation of your account or
(3) your receipt of an e-mail from ALLNET4U confirming your order, whichever happens first.
"Allnet4u", "ALLNET4U.COM", "Allnet4u.com," "we," "our" and grammatical variants thereof shall collectively refer to Allnet4u private Web Hosting provider.
1. DEFINITIONS.
The purpose of this AUP is to inform all Customers of acceptable, anticipated Customer use. Due to the number of possibilities in maintaining a network comprised of thousands of servers, this AUP is intended to act as a guideline to service and not to be all encompassing.
The primary purpose of the Allnet4u Hosting Public Network is to transmit information (packets) to and from Customer servers and data storage services. Proper use of the Allnet4u Network is to utilize the network in any way so long as Customer does not violate any local, state, or federal laws or generate harm to the network or interfere with the use of services of other users utilizing the same network. All Customers are granted equal access to the Public Network. Violation, misuse, or interference of the public network shall be considered a violation of the AUP and shall trigger the Methods of Resolution under this AUP as set forth below.
2. DESCRIPTION
Subject to and conditioned upon Allnet4u's retained rights and all other terms and conditions set forth in this Agreement, Allnet4u offers the Services as soon as practicable after registration for and payment of any and all fees due.
You are responsible for maintaining the confidentiality of both your password and your account and are fully responsible for all activities that occur under your account.
The Customer is ultimately responsible for individual server security unless contracted security services are purchased.
You agree to immediately notify Allnet4u of any unauthorized uses of the account or any other breaches of security.
Allnet4u cannot and will not be liable for any loss or damage from your failure to comply with this security obligation
2a.Mailbox usage
Your combined mailbox space per account shall not exceed twenty five (25) megabytes of contents (email saved). You are responsible for monitoring your mailbox use in order to ensure this compliance
Should you exceed your mailbox use limits Allnet4u may remove the contents or part of the contents or ask you to upgrade your accounts.
2b Backups
You are responsible for backing up Your Data on your own computer. Allnet4u does not warrant or otherwise guarantee that it will back up your data or that data which has been backed up can be retrieved, and will not be responsible for any archiving or backup of Your Data.
If any of Your Data is damaged, deleted, lost or corrupted in any way, or becomes otherwise unavailable due to termination or suspension of your account pursuant to this Agreement, Allnet4u will have no obligation or liability to you.
You have the right to keep up to 1 Gygabyte of backup on your site in zipped files. The contents must be relative to your website and not files not used by your sites.
2.c Shared hosting account VS Reseller Hosting account
If you opt-in for shared hosting account, you must NOT in any case resell, give , lease, or any other ways host sites not owned by you.
Unlimites Shared is limited to 25 hosted sites.
2d. Overload
Clients are not permitted to exceed 20% CPU utilization at any given time. In the event your site uses more than 20% of the CPU, Allnet4u Hosting will generate a ticket under your e-mail address to find an alternative solution for your hosting needs.
3. FEES
All Fees must be paid 1 month in advance in US Dollars. We are not accepting e-check.
If your payment fails after 3 times, on the third times Allnet4u will suspend your account and will send a notice to the email addresse we have on record. If you fail to answeer , Allnet4u reserve the right to remove your account and all the contents from his servers in a period of 15 days after the first payment failure.
4. SECURITY.
4a. Allnet4u Hosting allows the use of private Internet Relay Chat (IRC) servers for communication among private parties. Allnet4u Hosting absolutely prohibits the use of IRC servers connected to public IRC networks or servers. IRC servers that result in interference of service, malicious network activity or increased demand on network security services are in direct violation of this AUP.
4b. Allnet4u Hosting does not allow the use of internet Peer-to-Peer software for file sharing purposes. Violation of the Peer to Peer policy shall trigger the Methods of Resolution under this AUP as set forth below.
4c. Allnet4u Hosting does not allow the use of Bit Torrent and Point-to-Point (“P2P”) software protocols on the public network. Violation of the Bit Torrent and Point-to-Point Software policy shall trigger the Methods of Resolution under this AUP as set forth below.
4d. Virtual Private Server’s are not permitted to exceed 20% CPU utilization at any given time. In the event your Virtual Private Server uses more than 20% of the CPU, Allnet4u Hosting will generate a ticket under your e-mail address to find an alternative solution for your hosting needs. Allnet4u Hosting also monitors IOPS activity from Virtual Private Servers. In the event a Virtual Private Server is using more than a reasonable share of IOPS a ticket will be generated under your e-mail address to find an alternate solution for your hosting needs. Allnet4u Hosting reserves the right to suspend your Virtual Private Server until we find a more appropriate solution for your needs.
4e. Allnet4u Hosting prohibits public Proxy related services on Virtual Private Serves.
4f. Direct copyright infringement and trademark infringement are direct violations of Allnet4u Hosting’s AUP.
4g. The sending or receiving of mass unsolicited email (SPAM) is a direct violation of Allnet4u Hosting’s AUP. This includes the direct sending and receiving of such messages, support of such messages via web page, splash page or other related sites, or the advertisement of such services.
4h. The sending, return, bouncing or forwarding of email to specified user(s) in an attempt to interfere with or over flow email services is a direct violation of Allnet4u Hosting’s AUP.
4i. The use of dedicated services to proxy email unsolicited users is a direct violation of Allnet4u Hosting’s AUP. Proxy email is defined as the use of dedicated services to act in concert with other services located inside and outside the network to achieve mass unsolicited email (SPAM) to unrelated third parties.
4j. The use of dedicated services to send, receive, forward, or post UseNet unsolicited email or posts is a direct violation of Allnet4u Hosting’s AUP. This includes UseNet services located within the Allnet4u Hosting network or unrelated third party networks.
4k. Any use of dedicated services in a manner which is defined or deemed to be statutorily illegal is a direct violation of Allnet4u Hosting’s AUP. This includes, but is not limited to: death threats, terroristic threats, threats of harm to another individual, multi-level marketing schemes, “ponzi schemes”, invasion of privacy, credit card fraud, racketeering, and other common illegal activities.
4l. Allnet4u Hosting has a zero-tolerance policy on child pornography and related sites. The hosting of child pornography or related sites or contact information is in direct violation of federal law and Allnet4u Hosting’s AUP. Allnet4u allow legal Adult sites.
4m. The Allnet4u Hosting network can be utilized for any type of individual, organizational or business use. This does not include threats to or harassment of individuals, organizations or businesses, Allnet4u Hosting seeks to serve only as the medium of exchange for information and refrains from decisions on freedom of speech.
4n. Allnet4u Hosting prohibits utilizing dedicated services or network services for fraudulent activities. Participation in fraudulent activities is in direct violation of state and federal law and Allnet4u Hosting’s AUP.
4o. Allnet4u Hosting absolutely prohibits the use of dedicated services or network services for the origination or control of denial of service attacks or distributed denial of service attacks. Any relation to DOS or DDOS type activity is a direct violation of Allnet4u Hosting’s AUP.
4p. Allnet4u Hosting prohibits the use of dedicated services for the hosting of terrorist-related web sites. This includes sites advocating human violence and hate crimes based upon religion, ethnicity, or country of origin.
4q. Allnet4u Hosting prohibits the storage, distribution, fabrication, or use of malware, including without limitation, virus software, root kits, password crackers, adware, key stroke capture programs and other programs normally used in malicious activity. Programs used in the normal ordinary course of business are deemed acceptable. Example: Security Company hosting at Allnet4u Hosting analyzes the latest root kit for new security analysis/software.
4r. Allnet4u Hosting strictly prohibits any activity associated with Phishing or systems designed to collect personal information (name, account numbers, usernames, passwords, etc.) under false pretense. Splash pages, phishing forms, email distribution, proxy email or any relation to phishing activities will result in immediate removal.
4s. High Yield Investment Plans or Ponzi schemes with the intent to defraud end users are illegal and not allowed on the network. This includes hosting, linking and or advertising via email websites or schemes designed to defraud.
Reporting Violation of the Acceptable Use Policy: Allnet4u Hosting accepts reports of alleged violations of this AUP via email sent to abuse@allnet4u.com. Reports of alleged violations must be verified and must include the name and contact information of the complaining party, and the IP address or website allegedly in violation, and description of the violation. Allnet4u Hosting owes no duty to third parties reporting alleged violations due to lack of privity in contract law. Allnet4u Hosting will review all verified third party reports and will take appropriate actions as described within Methods of Resolution as set forth above below or within its sole discretion.
• Disclaimer – Allnet4u Hosting retains the right, at its sole discretion, to refuse new service to any individual, group, or business. Allnet4u Hosting also retains the right to discontinue service without notice.
5. PRIVACY.
It is Allnet4u's policy to respect your privacy. Allnet4u will not monitor, edit, or disclose any personal information about you or your account, including its contents, unless Allnet4u deems it necessary, in its sole discretion, to: comply with legal process or other legal requirements
6. SATISFACTION GUARANTEE.
Uptime Guarantee
I Allnet4u is almost reaching 100% uptime in 2009-2010, this is due to our High expertise in security in dedicated servers.
You can count on us to have your site running day and night.
We guarantee 99.8% network uptime in any given month (excluding scheduled maintenance). So certain of this, we will give you a 10% refund of your monthly fee when for every 1 hour your server's network is down
(up to 100% of your monthly fee). Network down time exists when a customer is unable transmit or receive data and our records show such failure.

The term Thirty Day Guarantee Period shall be defined as the period extending from the date a Customer signs up his or her new account with Allnet4u through the thirtieth (30) day following the initial signup of the first domain enrolled.
6.1. Cancellations requested within the Thirty Day Guarantee Period are eligible for a full refund, less setup fees (if there are), and add-on-service fees which are non-refundable. Cancellations requested outside the Thirty Day Guarantee Period are not eligible for a refund in part or in full.
6.2. Cancellation requests will only be accepted via email or phone call originating from the contact details of that account holder
6.3. Customer will not receive a refund for any other reason, including but not limited to: late cancellation, slow connection caused by Customer's ISP/network, Customer's ignorance, InterNIC delays, account termination for violation of policie, for any setup fees or any other fees including the transaction fees and refund transaction fees charged by PayPal, or any other payment processor, unless otherwise determined by Allnet4u.
